General terms

1.1. This Privacy Policy describes how SIA ZEN DESIGN, reg. No. 40203458588, VAT payer LV40203458588, legal address: Jūrmala, Lielais prospekts 9-2, LV-2010 (hereinafter referred to as the “Data Controller”) obtains, processes and stores personal data obtained by the online store shantitelpa.lv from its clients and persons who visit the website (hereinafter referred to as “Data Subject” or “You”).

1.2. Personal data is any information relating to an identified or identifiable natural person, i.e., Data Subject. Processing is any operation related to personal data, for example, obtaining, recording, modifying, using, viewing, deleting or destroying.

1.3. The Data Controller observes the principles of data processing set out in legislation and ensures that personal data is processed in accordance with current legislation.

Acquisition, processing, and storage of personal data

The Controller obtains, processes and stores personally identifiable information mainly using the online store's website and Email.

By visiting and using the services provided in the online store, you agree that any information provided will be used and managed in accordance with the purposes specified in this Privacy Policy.

The data subject is responsible for ensuring that the submitted personal data is correct, accurate, and complete. Knowingly providing false information is considered a violation of this Privacy Policy. The data subject is obliged to immediately notify the Controller of any changes in the submitted personal data.

The Controller is not responsible for any losses caused to the data subject or third parties if they have occurred due to the submission of false personal data.

Processing of customer personal data

3.1. The data controller may process the following personal data:

Name, surname
Date of birth
Contact information (Email address and/or phone number)
Transaction data (purchased goods, delivery address, price, payment information, etc.)
Any other information submitted during the purchase of products and services offered on the website or when contacting us.

3.2. The data controller has the right to verify the accuracy of the submitted data using publicly available registers.

3.3. The legal basis for personal data processing is Article 6(1)(a), (b), (c) and (f) of the General Data Protection Regulation:

(a) The data subject has given consent to the processing of their personal data for one or more specific purposes;
(b) Processing is necessary for the performance of a contract to which the data subject is a party or in Order to take steps at the request of the data subject prior to entering into a contract;
(c) Processing is necessary for compliance with a legal obligation to which the controller is subject;
(f) Processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject.

3.4. The data controller stores and processes the personal data of the data subject as long as there is at least one of the criteria mentioned below:

Personal data is necessary for the purposes for which it was received;
As long as the data controller and/or the data subject can exercise their legitimate interests (for example, in the case of legal proceedings);
As long as there is a legal obligation to retain the data (for example, in accordance with the Accounting Law);
As long as the data subject's consent to the respective processing of personal data is valid.

Upon expiry of these conditions, all personal data is irreversibly deleted or anonymized.

3.5. In Order to fulfill obligations towards the client, the data controller has the right to transfer personal data to cooperation partners and data processors, such as accounting service providers, courier services, and payment processing platforms.

The online store uses the WooPayments platform, which offers secure online payment processing, allowing Payments with debit cards, credit cards (Visa, MasterCard, American Express), as well as other local payment methods (such as Apple Pay, Google Pay) depending on the payment type and region chosen by the client.

Upon request, personal data may be provided to state and law enforcement authorities if necessary for the protection of legal interests.

3.6. When processing and storing personal data, the Data Controller implements organizational and technical measures to ensure data protection against accidental or unlawful destruction, alteration, disclosure, and any other unlawful processing.

Data subject rights

4.1. In accordance with the General Data Protection Regulation and the laws of the Republic of Latvia, you have the right to:

Access your personal data, receive information about its processing, as well as request a copy of your data in electronic format and the right to data portability;
Request correction of inaccurate or incomplete personal data;
Request erasure of your personal data (“right to be forgotten”), unless restricted by legal obligations;
Withdraw your consent for data processing;
Restrict the processing of your data;
Contact the Data State Inspectorate regarding violations of your information protection.

Final provisions

5.1. This Privacy Policy is developed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (General Data Protection Regulation), as well as current laws of the Republic of Latvia.
